We are an influencer marketing agency dedicated to connecting brands with influencers to create effective, engaging and compliant content. Our services include identifying influencer-client matches, facilitating agreements and offering support to ensure campaigns are successful.

2. Your relationship with Essex Influencers

Essex Influencers Ltd. is an intermediary between influencers and brands — ensuring a smooth collaboration.

  • For influencers: You remain an independent contractor, not an employee of Essex Influencers or the brands we connect you with.

  • For brands: Essex Influencers provides a service to connect you with suitable influencers and offers guidance on content creation and risk management.

We do not guarantee specific outcomes but will work diligently to support your goals.

3. Data collection and usage

We take data protection seriously and comply with the Data Protection Act 2018 and GDPR.

  • Why we collect data: We collect personal information and social media handles from influencers to create profiles and portfolios shared with potential clients.

  • How we use data: Information and publicly available content (e.g., images, videos, captions) from your social media profiles may be used to present your portfolio to brands.

  • Storage and protection: Your data is stored securely and only used for agreed purposes.

4. Risk management and intellectual property

Essex Influencers Ltd. actively supports influencers and brands in mitigating risks and ensuring compliance with intellectual property (IP) laws.

4.1. Intellectual property compliance

  • Influencers must use original content or properly licensed materials. If you unknowingly use copyrighted material, Essex Influencers Ltd. will help you address the issue promptly.

  • Brands must ensure assets provided to influencers (e.g., logos, slogans) are free from third-party claims.

4.2. Disputes over content

In case of a third-party claim (e.g., copyright infringement):

  • Influencers and brands must cooperate to resolve the issue.

  • Essex Influencers will assist in mediating disputes and suggest necessary changes.

While we provide risk management guidance, final responsibility for content lies with the influencer and brand.

5. Your responsibilities

5.1. Influencers

  • Maintain accuracy in the information you provide during registration.

  • Follow advertising regulations, intellectual property laws and Essex Influencers Ltd.’s guidelines.

  • Agree to remove or modify content if a legal claim arises.

5.2. Brands

  • Provide clear briefs and materials that comply with legal requirements.

  • Promptly notify Essex Influencers Ltd. of any concerns regarding influencer content.

6. Our commitments

6.1. To influencers

  • Facilitate connections with reputable brands.

  • Provide resources and guidance to help you succeed in collaborations.

6.2. To brands

  • Match you with influencers aligned with your goals and values.

  • Offer support throughout the campaign to ensure compliance and maximise results.

7. Limitations of liability

Essex Influencers Ltd. will not be liable for:

  • Indirect or consequential losses, such as loss of revenue, goodwill or reputation.

  • Third-party claims related to content unless due to Essex Influencers Ltd.’s gross negligence.

  • Any claim amount exceeding the total fees paid to Essex Influencers Ltd. by the affected party in the 12 months prior to the claim.

We will assist in resolving disputes and offer reasonable support to both influencers and brands.

8. Legal compliance

All parties must comply with relevant laws, including but not limited to:

  • Intellectual property and copyright laws.

  • Data protection and privacy regulations.

  • Advertising standards and disclosure requirements.

9. Dispute management

In the event of a dispute:

  1. Essex Influencers Ltd. will mediate between influencers and brands to seek a resolution.

  2. If unresolved, disputes may be escalated to arbitration under the laws of England and Wales.

10. Termination of services

Essex Influencers Ltd. reserves the right to terminate services if:

  • There is a breach of these terms of service.

  • Actions by influencers or brands harm Essex Influencers Ltd.’s reputation or operations.

11. Amendments

We may update these terms of service from time to time. Updates will be published on our website, and continued use of our services constitutes acceptance of the changes.

12. Governing law

These terms of service are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
